Terms of Service — USABRAZ3D

1. Acceptance of Terms

By accessing or using the USABRAZ3D website and services, you agree to be bound by these Terms of Service.

If you do not agree with these Terms, please do not access or use our services.

2. Description of Services

USABRAZ3D provides custom digital manufacturing services, including 3D printing, laser engraving, laser cutting, and the sale of custom-made products manufactured on demand.

3. Responsibility for Files and Designs

3.1. Customer Representations

The customer represents and warrants that they own or have obtained all intellectual property rights, licenses, authorizations, and permissions necessary for any files, designs, logos, images, text, or other materials submitted for production.

3.2. Intellectual Property Infringement

USABRAZ3D shall not be held responsible for any copyright, trademark, patent, or other intellectual property infringement resulting from the use or production of materials provided by the customer.

3.3. Right to Refuse an Order

USABRAZ3D reserves the right to refuse or cancel any order that may violate the intellectual property rights of a third party, including, but not limited to, copyrighted characters, trademarks or brand logos used without authorization, and patented designs.

3.4. Indemnification

The customer agrees to indemnify, defend, and hold harmless USABRAZ3D, its owners, employees, contractors, and representatives from and against any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising from or related to an infringement of intellectual property rights involving materials supplied by the customer.

4. Order and Quotation Process

4.1. Quotation Validity

Quotations are valid for seven (7) calendar days from the date of issuance, unless otherwise stated in writing.

4.2. Production Authorization

Production will begin only after the required payment has been received and the customer has provided written approval by email or through our ordering system.

4.3. Prototype or Proof Approval

For qualifying custom orders, USABRAZ3D may provide photographs of a prototype or proof before final production.

Once the customer approves the prototype or proof, that approval is considered final and cannot be reversed.

5. Payment

5.1. Accepted Payment Methods

USABRAZ3D accepts credit cards, debit cards, PayPal, and bank transfers.

5.2. Custom Orders

Custom orders may require either:

• A fifty percent (50%) deposit upon approval, with the remaining fifty percent (50%) due before shipment; or
• Full payment in advance.

The applicable payment terms will be specified in the customer’s quotation or invoice.

5.3. Online Store Products

Products purchased directly from our online store must be paid for in full at checkout.

6. Production and Delivery Times

6.1. Estimated Time Frames

Any production, processing, or delivery time provided by USABRAZ3D is an estimate and is not guaranteed.

Time frames may vary due to demand, project complexity, material availability, shipping carriers, suppliers, or other external factors.

6.2. Force Majeure

USABRAZ3D shall not be liable for any delay or failure to perform caused by events beyond its reasonable control, including, but not limited to, natural disasters, severe weather, labor disputes, transportation disruptions, supply shortages, government actions, power outages, or interruptions to internet or communication services.

7. Return and Refund Policy

7.1. Custom-Made Products

Custom-made and personalized products are not eligible for return, exchange, or refund, except in cases of a verified manufacturing defect.

The customer must report any alleged manufacturing defect within seven (7) business days after delivery. The report must include photographs and a detailed description of the issue.

7.2. Ready-Made Store Products

Non-customized, ready-made products purchased from our store may be returned within fourteen (14) calendar days after delivery, provided that they are unused, undamaged, and returned in their original packaging with all included accessories.

Unless otherwise required by applicable law or agreed to in writing by USABRAZ3D, the customer is responsible for return shipping costs.

7.3. Manufacturing Defects

If USABRAZ3D confirms that a product contains a manufacturing defect, the customer may choose between:

• Reprinting or reproducing the defective product at no additional cost; or
• Receiving a full refund for the defective product, including the applicable original shipping charge.

8. Limitation of Liability

8.1. Maximum Liability

To the fullest extent permitted by applicable law, USABRAZ3D’s total liability arising from or related to any claim shall not exceed the amount paid by the customer for the specific order giving rise to the claim.

8.2. Exclusion of Certain Damages

To the fullest extent permitted by applicable law, USABRAZ3D shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, revenue, business opportunities, data, or use, arising from or related to the website, products, or services.

9. USABRAZ3D Intellectual Property

9.1. Website Content

All content available on the USABRAZ3D website, including text, images, graphics, logos, videos, designs, and other materials, is owned by USABRAZ3D or licensed for its use and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, published, or used without prior written authorization from USABRAZ3D or the applicable rights holder.

9.2. Production Files and Designs

Unless otherwise agreed in a written contract, the customer does not acquire ownership rights in any molds, production methods, printing configurations, machine settings, technical files, or designs created by USABRAZ3D.

Ownership rights may be transferred only when the applicable services are expressly commissioned and documented in writing as a “work made for hire” or through a separate written assignment of intellectual property rights.

10. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the State of Oregon and the applicable federal laws of the United States of America, without regard to conflict-of-law principles.

Any dispute arising from or related to these Terms, USABRAZ3D’s services, or an order placed with USABRAZ3D shall be submitted to the state or federal courts of competent jurisdiction located in the State of Oregon, unless otherwise required by applicable law.

11. Changes to These Terms

USABRAZ3D reserves the right to modify or update these Terms at any time.

The most current version will always be posted on this page with its applicable “Last Updated” date.

Continued use of our website or services after an updated version is published constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
